FDIC Provides Additional Clarification Regarding Changes to Background Screening Requirements
The FDIC has issued a summary of changes regarding recent amendments to Section 19 of the Federal Deposit Insurance Act, which establishes hiring and background screening regulations for FDIC-member banks.
Notable changes to Section 19 include updates to hiring requirements regarding:
- Exclusion of certain older offenses;
- De minimis offenses that do not require an application;
- Crimes excluded from the definition of criminal offenses involving dishonesty;
- Expunged, sealed, and dismissed offenses;
- FDIC review of Section 19 applications; and
- FDIC actions related to the changes.
