FMCSA Regulation to Impact Drivers with 'Prohibited' Clearinghouse Status Starting November 18, 2024

Beginning November 18, 2024, commercial drivers with a "prohibited" status in the Federal Motor Carrier Safety Administration's (FMCSA) Drug and Alcohol Clearinghouse will lose or be denied their commercial driving privileges.

State Driver Licensing Agencies will be required to remove commercial driving privileges from individuals with a "prohibited" status, which typically indicates a drug or alcohol program violation and prevents drivers from performing safety-sensitive functions. Employers may notice an uptick in license downgrades, reflected in MVR reports as suspensions or restrictions on driving privileges. Some states may opt to downgrade licenses before the November 18 deadline.

To legally return to work, drivers must resolve these violations by completing the required return-to-duty process. These updated regulations are intended to protect public safety by keeping drivers with unresolved drug and alcohol violations off the road.

Employers should monitor the Clearinghouse status of their drivers to avoid potential compliance issues.
